The regularly scheduled meeting of the County Commissioners of Caroline County, Maryland, convened at 9:30 AM in the Commissioners’ Hearing Room #103, Courthouse, Denton.

On motion by Mr. Cole, the minutes of August 4, 1998 were approved as corrected. Vouchers #41829 – 41961 were approved for payment. The biweekly direct payroll was approved.
The Commissioners held an advertised bid opening for project #CC-GD-81198, annual fuel supply, with the following bids being publicly opened, read aloud and recorded.

Bids were referred to staff for evaluation.
The Commissioners signed a proclamation presented by Sue Simmons declaring August 14,
15 and 16, 1998, as Summerfest days.
On motions indicated, the Commissioners unanimously approved and President Myers signed the following purchase orders:
#12226 - Farrell Enterprises - $1,250 - 1998 Summerfest entertainment less deposit (LeGates);
#12229 - Britannia Soccer, Ltd. - $4,379 - 1998 summer camp (reimbursed with participant
fees (Cole).
On motion by Mr. Cole, the Commissioners unanimously accepted the low bid of Boyd & Dowgiallo for project #CC-CM-8498, Choptank Marina engineering services, in the amount of $10,500; and rejected all other bids received. President Myers signed a purchase order in that amount.
On motion by Mr. Cole, the Commissioners unanimously accepted the sole bid of Applied Computers, Inc., for project #CC-CM-8498, health department computer relocation and maintenance ($45 hourly for relocation and maintenance during normal business hours; $70 hourly otherwise). Marvin MacDonald, purchasing officer, reported that one bid arrived after the bid submittal deadline, but in accordance with County purchasing law, it was not opened.
On motion by Mr. LeGates, the Commissioners authorized solicitation of advertised bids for selected new and replacement traffic signs.
On motion by Mr. LeGates, the Commissioners unanimously approved and President Myers signed the following Acceptance Certificates with First Union National Bank and Corporate Trust Department for ALS vehicles:
#7 - truck chassis from M & L GMC-Volvo Truck Center - $22,992; and
#8 - vehicle body remount by MedTech Ambulance Corporation - $20,275.
Following presentation by the County treasurer, the Commissioners, on motion by Mr. LeGates, unanimously signed the County Semiannual Investment Report for the first half of 1998.
Helen Spinelli, Maryland Rural Development Corporation, introduced Glynn Hodges, new MRDC circuit rider town manager, who will be assisting Goldsboro, Marydel and Henderson and five small towns in Dorchester County. He distributed a copy of his work program. Caroline County has budgeted funds toward the Caroline portion of this year’s $41,200 program budget.
Bobby Schoonover, ALS coordinator, presented the revised Caroline County Medical Director Agreement, which on motion by Mr. LeGates, was unanimously approved and signed. The Agreement contracts specified pre-hospital emergency medical services with Roger Stone, M.D. Dr. Stone shall, subject to approval by the state EMS medical director, serve as jurisdictional medical director, and provide at least eight hours of services a month on site in Caroline County to fire companies, ALS, and County departments for $12.50 an hour plus travel expenses. The contract will be re-evaluated in about a year.
On motion by Mr. LeGates, the Commissioners unanimously approved and President Myers signed a Lease Agreement with Barbara J. Quinn, trading as Franklin Square Investments, for 1,144 sq. ft. of space on the first floor of the Franklin Square Building, Denton, for relocation of the Caroline County emergency management department, whose current site on Market Street has been sold. The term of the lease is for six months beginning August 10, 1998, with a month-to-month renewal option, and the rent is $810 a month. Landlord pays all utilities including telephone.
On motion by Mr. LeGates, and as requested by the County planner, the Commissioners unanimously approved and signed the following Resolution #98-009, Adoption of Caroline County Solid Waste Management Plan, having previously held a public hearing on the Plan.

ADOPTION OF
CAROLINE COUNTY
SOLID WASTE MANAGEMENT PLAN
1998 – 2008
WHEREAS, the County Commissioners are empowered by the Environmental Article, Title 9, Subtitle 5 of the Annotated Code of Maryland to adopt and amend a Solid Waste Management Plan; and
WHEREAS, the Caroline County Planning Commission has authorized the preparation of the proposed Solid Waste Management Plan and recommends it to the County Commissioners for adoption;
WHEREAS, the proposed Plan has been developed with the assistance of the Caroline County Department of Public Works and the Caroline County Office of Planning and Codes Administration;
WHEREAS, the County Commissioners have held a duly advertised public hearing on this proposed Plan on August 4, 1998.
NOW, THEREFORE, IT IS HEREBY RESOLVED THAT the Caroline County Solid Waste Management Plan 1998 – 2008 is hereby adopted.
ADOPTED/EFFECTIVE THIS 11th day of August 1998.

At 10:45 AM, and as authorized by 1995 Md. Code, State Government 10-508(a)(7) and (a)(1), the Commissioners, on motion by Mr. Cole, seconded by Mr. LeGates, adjourned into closed session to discuss with Bobby Schoonover, ALS coordinator, and Ellis Davison, deputy County attorney, the lawsuit against the County by certain ALS responders; and to discuss possible nominees to constitute the Agricultural Reconciliation Committee required by the County right-to-farm law.
On motion by Mr. LeGates, the meeting reconvened in open session at 11:15 AM. President Myers reported that in closed session that the Commissioners discussed proposed settlement of the ALS suit, and suggested names of persons to be contacted regarding their willingness to serve on the Agricultural Reconciliation Committee.
On motion by Mr. Cole, the Commissioners unanimously authorized the following settlement payment from the contingency fund: $24,426.81 - Mulholland & Hickey, attorneys - liquidated damages to ALS plaintiffs and legal costs for settlement agreement in Civil #CCB97-3128.
President Myers discussed her recent meetings with officials of Upper Shore counties regarding possible reconfiguration of the Upper Shore Economic Development Partnership to enable it to function more effectively.
